Estimates & Authorization
Estimates are subject to change. If additional costs exceed the original estimate by more than 20%, we will contact you before proceeding. Work remains paused for up to 5 business days awaiting your approval. If we are unable to reach you within that period, work will cease and the bike will be available for pickup at the current partial-repair stage. Payment is due in full at pickup before the bike is released.
Customer-Supplied Parts
Jenson USA does not warranty labor performed with customer-supplied parts. If a customer-supplied part fails, is incompatible, or causes damage, additional labor charges will apply and will be communicated before work resumes. Jenson USA is not liable for damage caused by customer-supplied parts.
Pre-Existing Conditions
Jenson USA is not responsible for failures or damage attributable to pre-existing conditions. Customers are encouraged to disclose any known pre-existing damage.
Cosmetic Damage
Minor cosmetic wear (e.g., light bench marks, minor scuffs from handling) may occur incidentally during the repair process. Jenson USA is not liable for such incidental cosmetic contact, but will exercise reasonable care in handling all bikes.
Test Rides
Staff may perform a brief test ride in the immediate vicinity of the store solely to verify repair quality. All rides will comply with applicable traffic laws. By agreeing to these terms, you authorize this limited use.
Storage & Pickup
Bikes must be picked up within 7 days of ready-for-pickup notification sent via the contact method on file (phone, email, or text). If the message is undeliverable, a second attempt will be made. Storage fees of $10/day accrue beginning on the 8th calendar day after the first notification attempt. You are responsible for providing accurate contact information — Jenson USA is not responsible for missed notifications due to incorrect information on file.
Unclaimed Bikes
Bikes unclaimed after 90 days, or where accrued storage fees meet or exceed the bike's fair market value, will be handled per California Civil Code §3051–3052, including required written notice and sale of the bike. Proceeds will be applied to outstanding balances; any surplus will be held per applicable law.
Warranty
Manufacturer warranties vary by brand and may be limited to original owners and parts only. You are responsible for any labor and shipping charges not covered by the applicable manufacturer warranty. Jenson USA will advise you of the specific warranty terms for your parts before proceeding with a claim.
Liability
Except in cases of gross negligence, willful misconduct, or fraud, Jenson USA's maximum liability is limited to the cost of the repair performed, to the fullest extent permitted by California law. Jenson USA reserves the right to refuse or discontinue service if a bike is found to be unsafe, structurally compromised, or if the scope of work changes materially from check-in.
Dispute Resolution
Any disputes arising from services performed shall first be subject to good faith negotiation. If unresolved, disputes shall be settled via binding arbitration through a mutually agreed upon arbitration service, rather than litigation. Any claim must be brought on an individual basis. To the extent permitted by applicable California law, class action claims are waived. Any claim arising from services performed must be filed within the shorter of (a) one year of the service date or (b) the applicable statutory limitations period under California law.
Governing Law
These terms are governed by the laws of the State of California. Any disputes not resolved through arbitration will be handled in Riverside County.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full effect.
